AI Receptionist provides an AI-powered virtual receptionist service that answers phone calls, schedules appointments, and handles customer inquiries on behalf of your business. The Service includes a dedicated phone number, call handling, transcription, and a dashboard for managing your receptionist.

3. Account Registration

To use the Service, you must create an account and provide accurate, complete information. You are responsible for:

Maintaining the security of your account credentials
All activities that occur under your account
Notifying us immediately of any unauthorized access

4. Subscription and Payment

Pricing

The Service is offered at $200 per month (currently $150/month with 25% promotional discount), billed monthly. All prices are in US dollars.

Free Trial

New customers receive a 3-day free trial. A valid payment method is required to start the trial. You will not be charged if you cancel before the trial ends.

Billing

Subscriptions are billed monthly in advance
Payments are processed securely through Stripe
You authorize us to charge your payment method on each billing date
Failed payments may result in service suspension

Cancellation Policy

You may cancel your subscription at any time through your account dashboard. Your AI receptionist will remain active until the end of your current billing period.

Refund Policy

Once your payment method has been charged, that payment is non-refundable. No refunds or credits will be issued for partial months of service, downgrade refunds, or unused time remaining in your billing period. If you cancel your subscription, you will not be charged for the following month, but you will not receive a refund for the current billing period already paid. 5. Acceptable Use

You agree not to use the Service to:

Engage in fraudulent, deceptive, or harmful activities
Transmit spam, harassment, or offensive content

Use the Service for illegal telemarketing or robocalling

6. Telephone Consumer Protection Act (TCPA) Compliance

You acknowledge and agree that you are solely responsible for compliance with the Telephone Consumer Protection Act (TCPA), the Telemarketing Sales Rule (TSR), and all other applicable federal, state, and local laws governing telephone communications, including but not limited to:

Do Not Call Registry: You shall not use the Service to call any telephone number listed on the National Do Not Call Registry or any state Do Not Call list, unless you have an established business relationship or prior express written consent from the recipient.
Prior Express Consent: For any outbound calling or SMS messaging features, you are responsible for obtaining and documenting proper consent from recipients before initiating contact.
Caller ID: You shall not use the Service to transmit misleading or inaccurate caller ID information.
Time Restrictions: You shall not use the Service to make calls before 8:00 AM or after 9:00 PM in the recipient's local time zone.
Internal Do Not Call List: You are responsible for maintaining your own internal do-not-call list and honoring opt-out requests within 30 days.

AI RECEPTIONIST DESK PROVIDES THE TECHNOLOGY PLATFORM ONLY. WE DO NOT VERIFY THE LEGALITY OF YOUR CALLING LISTS OR CAMPAIGNS. YOU ASSUME ALL RISK AND LIABILITY FOR TCPA VIOLATIONS, WHICH CAN RESULT IN STATUTORY DAMAGES OF $500 TO $1,500 PER CALL OR MESSAGE.

7. Phone Numbers

We provide you with a dedicated phone number for your AI receptionist. This number remains our property and is licensed to you for the duration of your subscription. Upon cancellation, you will lose access to the phone number.

8. Call Recording and Transcription

All calls handled by the AI receptionist may be recorded and transcribed. You are responsible for complying with applicable laws regarding call recording and disclosure in your jurisdiction. You agree to inform callers that calls may be recorded where required by law.

9. Service Availability

We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. We are not liable for any downtime, delays, or service interruptions caused by factors beyond our reasonable control.

10. Intellectual Property

The Service, including its software, design, and content, is owned by AI Receptionist and protected by intellectual property laws. You retain ownership of your business information and content you provide to customize your receptionist.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI RECEPTIONIST SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE TWELVE MONTHS PRECEDING THE CLAIM.

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE AI WILL HANDLE ALL CALLS PERFECTLY OR THAT THE SERVICE WILL MEET ALL YOUR REQUIREMENTS.

13. Indemnification

You agree to indemnify and hold harmless AI Receptionist from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

14. Termination

You may cancel your subscription at any time through your dashboard or by contacting support. We may suspend or terminate your account for violation of these Terms or non-payment. Upon termination, your access to the Service and your phone number will be discontinued.

15. Changes to Terms

We may modify these Terms at any time. We will notify you of material changes via email or through the Service. Continued use after changes constitutes acceptance of the new Terms.

16. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
